Coventry council obtains its first banning order against a private landlord

In what Coventry council calls a "landmark case" it has obtained its first banning order against a "rogue landlord".

The landlord was described as having "a long history of poor property management" and he had already been convicted "on several occasions" of breaching housing laws and regulations with the most recent conviction being in July 2021 for breach of HMO regulations when he pleaded guilty and was fined £1,350 and ordered to pay a victim surcharge of £135.

Due to the seriousness of the offences the council decided to seek a banning order prohibiting the landlord from renting out properties. The offences, which involved serious fire safety failures, came to light during an inspection by council licensing officers in 2019 after which landlord was interviewed under caution. During the interview "it became apparent that he had failed to actively manage the property and was unable to produce any evidence of fire safety logs or inspections he had undertaken to ensure the property was safe."

The First Tier property tribunal issued the banning order on July 29th 2022 saying they "were unimpressed by [the landlord's] attempts to avoid or diminish the seriousness of having been convicted of fire safety breaches." The landlord has also been added to the national rogue landlord database.
